6.4.1.3 Events that affect a worker's entitlement
The following events impact a worker's entitlement to settlement A lump sum payment that replaces an injured worker's right to ongoing weekly compensation..
Death of the worker
If a worker dies before accepting an offer of settlement, there is no entitlement
Imprisonment of the worker
If a worker is incarcerated at any stage during the settlement process, the Agent must cease all settlement processing and consider whether to reject the application.
The non-entitlement to weekly payments while in jail will provide the basis to reject the settlement.
Worker turns 64 years of age
Workers remain entitled to a settlement if they lodge an expression of interest before their 64th birthday and they meet all other eligible criteria.
